Design, Exclusivity & Content Rights.
Design Rights
Present retains full ownership of all designs, drawings, specifications, production methods, adaptations and developments created as part of its services, unless exclusivity is agreed in writing prior to production.
Clients are granted the right to use their commissioned pieces within their own home, commercial space or project.
Unless otherwise agreed, Present reserves the right to reproduce, adapt and develop designs created through our production process. This allows us to refine and build on our work over time and offer proven designs to future clients.
Some designs may become part of our made-to-order collection and be available for future clients to adapt and reproduce.
Exclusivity
If a client would like a design to remain exclusive and not be reproduced for other clients, this can be arranged as an additional service.
Exclusivity must be agreed in writing prior to production and is not included as standard.
Exclusivity is priced on a case-by-case basis depending on the scope and nature of the design. Depending on the project, exclusivity may be:
- time-limited
- limited to a specific geography
- limited to a specific project type
All exclusivity arrangements are confirmed in writing before production begins. Pricing details are set out in our Terms & Conditions.
Content Rights
Portfolio, website, social and marketing use of completed work is permission-based. We do not assume the right to share images of your project — consent is captured at quote time, defaults to off, and can be withdrawn in writing any time before delivery.
When permission is granted, content is focused on the design, materials and production quality. We never disclose private addresses, identifying details or other sensitive information without separate explicit consent.
Internal documentation (production records, dimensions, materials specifications) is retained regardless for operational and quality-control purposes. This is not used externally.
A note on portfolio sharing
Many clients are happy for us to share — content is how we grow and how new clients find us. We always ask, and the choice is yours.
Choosing not to grant portfolio rights does not affect production, lead time or pricing on any project of any size or budget.
Formal non-disclosure
If a project requires contractual confidentiality beyond the default — for example, protecting drawings, specifications or production methods from disclosure — a formal non-disclosure arrangement is available as a paid add-on. This binds us to additional confidentiality terms beyond standard practice.
Pricing is on a case-by-case basis depending on scope, and is agreed in writing before production begins. Pricing details are set out in our Terms & Conditions.
